Terms and Conditions of Service

Effective version: January 1, 2025

I. Purpose and Acceptance

This agreement sets forth the conditions under which web.com.do S.R.L. ("web.com.do") provides cloud infrastructure services, including but not limited to: virtual servers (VPS), managed Kubernetes, object storage, managed databases, and managed applications. New deployments are provided from our MIA-1 Miami US-edge region (~30ms to Dominican users). Dominican datacenter regions (SDQ-1, STI-1, POP-1, PUJ-1) are returning; customers may join a waitlist from the console.

Any registration, subscription, or renewal of a web.com.do service implies full and unconditional acceptance of this agreement.

Given the constant evolution of the technology sector, web.com.do reserves the right to modify this agreement at any time. If changes apply to the current billing period, the customer will be notified by email with a minimum notice of thirty (30) days to accept or reject the new conditions. If the service remains active after that period, the customer will be deemed to have accepted the modifications. Otherwise, the customer may request termination of the agreement with a proportional refund for the remaining months, according to the procedure set out in clause V.

II. Term and Payment

web.com.do contracts are entered into for the minimum term specified at the time of subscription. Payment for services rendered is due in advance.

Accepted payment methods

Accepted payment methods include:

All prices are expressed in Dominican Pesos (DOP) and include the 18% ITBIS (Tax on the Transfer of Industrialized Goods and Services), in accordance with Dominican tax law. Invoices are issued with a valid Tax Receipt Number (NCF) before the General Directorate of Internal Taxes (DGII). Entities registered with the DGII must provide a valid RNC at the time of subscription.

  • Credit and debit cards processed by Azul and CardNET
  • Bank transfers in Dominican Pesos (DOP)

Payment default

Any payment incident or delay will automatically generate, after prior notice, a late penalty equal to ten percent (10%) of the amounts owed, as well as delay penalties calculated at 1.5 times the prevailing legal interest rate.

web.com.do reserves the right to suspend access to its services from the first day of payment delay, keeping them suspended until payment is made in full.

The customer is expressly informed and accepts that hosted data will be deleted from the contracted service thirty (30) days after the due date shown in the customer panel. The service will then be permanently terminated. It is the customer's responsibility to make the necessary backups before that deadline.

The customer may request early destruction of their data by contacting web.com.do, and may request confirmation of such destruction at any time.

web.com.do reserves the right to pass on without delay any new tax or increase in existing tax rates that affects the provision of services.

III. Cloud Infrastructure Service

1. Content and acceptable use

Data hosted or processed through web.com.do services must comply with the laws in force in the Dominican Republic, including but not limited to Law 53-07 on High-Tech Crimes and Offenses and Law 172-13 on Comprehensive Protection of Personal Data.

The following types of content are strictly prohibited, whether or not publicly accessible:

The customer agrees not to redirect their domain (including hyperlinks) to sites that distribute unlawful content as described above.

Sending email through web.com.do services is not limited in normal, non-automated use. For automated email sending, the limit is twenty thousand (20,000) messages per day. Unsolicited email (SPAM) is strictly prohibited and may result in immediate suspension without prior notice of the affected account. All bulk email sends must have prior consent from recipients.

In all cases mentioned above, web.com.do may terminate the agreement without prior notice or compensation. The customer is solely responsible for content hosted and distributed on their account.

  • Files protected by intellectual property rights without express authorization from the rights holder.
  • Defamatory, injurious, racist, xenophobic content or content that incites discrimination or the commission of crimes.
  • Pornographic or sexual exploitation content.
  • Malware, exploits, ransomware, or other tools designed to cause harm.
  • Cryptocurrency mining activities not expressly authorized by web.com.do.
  • DDoS attacks, botnets, or any activity that affects the stability of third-party networks or systems.
  • Any content that violates applicable Dominican or international law.

2. Resource protection

Within shared infrastructure services, the customer agrees to respect the following restrictions to preserve performance and environmental stability:

In general, the customer will be notified in case of excessive use before their service is suspended. However, web.com.do reserves the right to suspend immediately and without prior notice if infrastructure stability is seriously compromised.

  • Do not run processes exceeding 2.9 GHz of CPU resources, 48 GB of RAM, or 420 consecutive seconds of intensive CPU use, or that consume more than 95% of a physical server's resources at any time.
  • Do not run programs in server mode (daemons, IRCD, eggdrops, IRC bots, etc.).
  • Do not run binaries other than those provided by web.com.do.
  • Do not store individual files exceeding 50 GB. Do not create directories with more than 20,000 files. Do not use more than 500,000 inodes in a single hosting space.
  • Do not use web.com.do services as a direct or indirect backup solution for external data.
  • Databases must be used exclusively to serve applications hosted on web.com.do infrastructure. External access is permitted only for development purposes, from a fixed IP address of an internet access provider.
  • Do not use contracted services as a basis to create a hosting or resale service to third parties.

3. Backups

web.com.do implements internal backup mechanisms on its production servers to restore service in case of hardware failure. These backups are incremental and without multiple history, and are subject to the customer being current on payment for their service.

Files with the following extensions are excluded from backups: .tar.gz, .tar, .iso, .img, .zip, .jpa, .7z, .rar, .mkv, .wav, .mp3, .flac, .avi, .mpeg, .mp4, .mpg, .tmp, .ogg, .wmv, .vdi, and any equivalent extension.

Backups are not performed when the service has more than 100,000 files in a single account, when content is unrelated to hosting applications or websites, or when files are encrypted, illegible, or corrupt.

web.com.do may make available to the customer, from their administration panel, a tool to recover archived data. The customer is responsible for periodically verifying that data visible in that tool meets their needs. Data visible from the panel represents the maximum content available for recovery.

The customer agrees to maintain their own copy, updated and in good condition, of all their data (including databases, application files, and configurations), stored on a medium independent of web.com.do infrastructure. It is recommended to perform this operation at least once a week. web.com.do's liability may not be invoked in case of data loss attributable to the customer's failure to comply with this obligation.

4. Customer responsibility for their environment

web.com.do provides the customer with a cloud infrastructure environment where the customer stores and manages their own data and applications. The customer is responsible for the management, maintenance, and security of all content hosted on their account.

The customer must ensure the integrity of their data, the security of access credentials provided by web.com.do, and the prevention of any improper use of services, whether voluntary or the result of a security breach. If a compromise of their environment is detected or suspected, the customer must notify web.com.do as soon as possible at info@web.com.do.

web.com.do may suspend, without compensation or prior notice, web access to any account containing phishing data or other fraudulent activities.

The outbound messaging (SMTP) service available to the customer implies that the customer independently verifies correct receipt of sent emails. Blocking of an email by a third party is the exclusive responsibility of that third party.

IV. Domain Names

If the customer contracts a domain name, it is their responsibility to verify its availability before proceeding with the subscription in the customer panel.

If the requested domain name is not available, web.com.do will notify the customer by email. If the customer holds rights to the domain, they may provide the codes and elements necessary to initiate transfer to web.com.do.

web.com.do draws the customer's attention to the fact that a domain transfer from an external provider does not automatically modify the registered holder information. Such information may correspond to the previous provider. The official domain holder determines all technical and administrative modification rights over it. The customer may request verification of holder data at any time by sending an email to info@web.com.do.

Domain holder change is free once, within three (3) months following service subscription, when the domain has been transferred to web.com.do. Outside this case, the operation has a cost equivalent to the current registration price for the corresponding extension.

A domain name registered through web.com.do constitutes a customized good under Dominican consumer law. For this reason, the right of withdrawal does not apply to the domain name once registered. If the domain is not available or cannot be transferred, the customer may request modification of their order at no additional charge.

web.com.do notes that a domain transfer does not imply automatic migration of content to its servers. The customer is responsible for managing the transfer of files and configurations necessary for proper operation of their applications on web.com.do infrastructure.

V. Personal Data Protection

web.com.do complies with Law 172-13 on Comprehensive Protection of Personal Data of the Dominican Republic, and with obligations arising from the European Union's General Data Protection Regulation (GDPR) to the extent applicable.

The customer must provide truthful and complete personal data, including a valid email address, when contracting a service. It is the customer's obligation to notify web.com.do of any change in their data via email to info@web.com.do or through the customer panel.

web.com.do commits to maintaining the confidentiality of this data. It will not be disclosed to third parties except under legal obligation or request from competent authorities within a judicial process.

Customer content for new deployments is processed and stored at web.com.do's MIA-1 Miami US-edge infrastructure. web.com.do maintains its commercial presence and billing operations in the Dominican Republic. When Dominican datacenter capacity returns, available region options may change. Customer data will be used exclusively for internal service management, billing, debt collection, and compliance with applicable legal obligations.

For domain name registration under certain extensions (.com, .net, .org, .do, etc.), the corresponding registries request personal information from the holder: full name, entity, postal address, and where applicable, date of birth. This information will be transmitted to the competent registries.

The customer may request that their personal data remain confidential before such registries by sending a request to info@web.com.do before or simultaneously with domain subscription. In that case, the domain will be registered under web.com.do's data. The customer may also request domain transfer at any time.

web.com.do retains internal logs solely to fulfill its legal obligations under Dominican and European Union law. The customer must inform their users about this practice. The customer may request deactivation of log analysis tools available to them by email to info@web.com.do.

The customer has rights of access, rectification, erasure, and objection regarding their personal data. To exercise them, they must send a duly identified request to: web.com.do S.R.L., Santo Domingo, Dominican Republic, or by email to legal@web.com.do.

Under this agreement, web.com.do acts as data processor, with the customer being the data controller for data processed through the services. The customer must communicate to web.com.do all relevant information about the intended processing purposes.

web.com.do implements reasonable technical and organizational measures to ensure the integrity, confidentiality, and security of data subject to processing.

During a technical support request, the customer expressly authorizes web.com.do to access the hosted environment and perform operations necessary for diagnosis and resolution of the incident. web.com.do technicians are subject to confidentiality obligations and professional secrecy.

VI. Service Level (SLA)

web.com.do guarantees 99.9% availability for all production services. In case of failure to meet this commitment, the corresponding service credit will apply as described in the current Service Level Agreement (SLA), available in the customer panel.

web.com.do may not be held liable for unavailability or any incident that is not directly its responsibility, or that depends on a third party outside its control (force majeure, origin connectivity failure, external attack, etc.).

web.com.do reserves the right to modify its infrastructure, technologies used, and services offered at any time, given the constant evolution of the technology sector.

VII. Right of Withdrawal

Under applicable Dominican law on distance contracts, the customer has a withdrawal period after activation of the contracted service. web.com.do, as a commercial gesture, extends this period to thirty (30) calendar days from the service activation date.

To exercise this right, the customer must send an email to comercial@web.com.do. web.com.do may not be held liable for incorrect processing of the request if the email is not received. The customer is informed that a refund implies total and definitive closure of the contracted service, as well as permanent and irreversible destruction of all hosted data.

If the contracted service includes a domain name, the amount corresponding to registration of that domain (at the individual rate in effect at the contract date) will be deducted from the refund. The domain name will remain available to the customer until expiration for any provider change.

The right of withdrawal does not apply to registered domain names, as they constitute customized goods under applicable law. This clause also does not apply in case of contract renewal.

VIII. Renewal and Termination

Before contract expiration, the customer will receive email notifications. However, given the use of automated systems, it is the customer's responsibility to verify the contract expiration date and renew in a timely manner. web.com.do is not responsible for exceptional failures in automation systems.

If the customer accepts renewal, they must select their payment method and follow the corresponding process in the customer panel.

If the customer does not respond to renewal notices, web.com.do will understand that they wish to close their account, which will be deactivated and deleted at the end of the current contract.

web.com.do may terminate the agreement by right for breach of any clause of this agreement. In such case, the customer may not claim any refund.

The customer has thirty (30) days from subscription to terminate their subscription (see clause VII). After that period, they must wait until the end of the contracted period with no possibility of early termination or proportional refund.

If the customer reactivates a service expired more than thirty (30) days ago, it will be considered that they have contracted a new service.

IX. Limitation of Liability

In no case may web.com.do be held liable for indirect, unforeseeable, or consequential damages, whether material or immaterial, such as loss of business, loss of profits, damage to image, or any other financial loss resulting from use or inability to use the service.

When web.com.do's liability is duly established by a competent judicial authority, the global and cumulative compensation, for any cause, will be limited to the amount actually paid by the customer to web.com.do during the six (6) months prior to the event giving rise to liability. This liability cap reflects the economic balance and risk distribution agreed between the parties, and will continue to apply even in case of resolution or termination of the agreement.

Any damage suffered by a third party is considered indirect damage and does not give rise to compensation by web.com.do.

X. International Sanctions Compliance

If the customer is directly or indirectly involved in generating income, conducting transactions, or establishing commercial relationships with countries, entities, or persons subject to sanctions under applicable national or international legislation (including, without limitation, sanction regimes of the United Nations, European Union, United Kingdom, and/or United States), web.com.do reserves the right to terminate this agreement, in whole or in part, by right, without prior notice, with immediate effect and without judicial intervention.

In such case, web.com.do will not be obligated to pay compensation or refund amounts already paid. All credits web.com.do holds against the customer will become immediately due.

XI. Jurisdiction and Applicable Law

This agreement is governed by the laws of the Dominican Republic. Any dispute arising from its interpretation or execution will be submitted, failing amicable agreement, to the competent courts of the National District, Santo Domingo, Dominican Republic.
